Terms of Service

You must be at least 18 years of age and have the legal authority to agree to these Terms on your own behalf or on behalf of your organization.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at sales@conncepts.pro if you become aware of any unauthorized access or use. We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms.

ERPulse provides monitoring, alerting, and remote-control capabilities for Epicor Kinetic environments via a Controller and one or more Helpers. The Service is provided “as is” and “as available.”

We do not guarantee 100% uptime, error-free performance, or specific results. Monitoring data is for informational purposes only — do not rely solely on it for critical operational decisions without independent verification.

• Provide accurate and current information when registering and using the Service.
• Ensure you hold the necessary rights and permissions to monitor and control the Epicor environments you connect to ERPulse (e.g., appropriate server and IIS permissions).
• Use the Service in compliance with all applicable laws and regulations. Do not use ERPulse for any illegal, unauthorized, or malicious purpose.
• Not attempt to reverse-engineer, copy, sublicense, or disrupt the Service or its underlying infrastructure.
• Maintain reasonable security practices for your own systems. We are not liable for security breaches originating in your environment.

Subscriptions are billed on a monthly or annual basis via Stripe. All fees are non-refundable except as expressly stated. We reserve the right to change pricing with reasonable prior notice. Late or failed payments may result in service suspension until the outstanding balance is resolved.

ERPulse and its licensors own all rights, title, and interest in the Service, including all software, content, trademarks, and documentation. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during your active subscription period.

You may terminate your subscription at any time through the portal. We may terminate or suspend your access immediately for breach of these Terms, non-payment, or conduct that we determine is harmful to other users or the Service, or at our discretion with reasonable notice where required by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ERPULSE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO ERPULSE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

You agree to indemnify, defend, and hold harmless ERPulse and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hernando County, Florida.

We may update these Terms from time to time. When we do, we will post the revised Terms on this page with an updated effective date. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the updated Terms.
